APIA, SAMOA – TUESDAY 01 MAY 2018: The father who is guilty of incest has been jailed for 1 year and 6 months while his daughter he had an incestuous relationship with is convicted and is to serve a 2 years supervision sentence. The daughter is also to carry out 200 hours of community work; attend a programme directed by the Probation Service; and is to have no contact with her father during her supervision period.
Both the father and daughter were sentenced yesterday in the Supreme Court by Justice Leiataualesā Daryl Clarke.
According to the Summary of facts, the pair was in an incestuous relationship between 31 December 2016 and 1 January 2018. One of the incidents was photographed and recorded by a villager and subsequently circulated within the village. From there, the matter was reported to Police.
The report stated that the 58 year old father initiated the sexual relationship with his daughter.
The 35 year old daughter is the eldest of 7 children. At the age of two months, she was adopted by her maternal grandmother.
In Justice Clarke’s ruling, he pointed out the level of culpability as significantly higher for the father than that of his daughter. He instigated the sexual intercourse and he persisted for it to take place. He is older and has abused his position of trust to engage in sexual acts with his daughter who despite being 35 years of age, was nevertheless vulnerable given her circumstances.
The court is suppressing the names and village details of the pair.
