Prosecution ordered to serve substitute charges on suspended editor no later than today

APIA: MONDAY 26 JANUARY 2015: Chief Justice Patu Tiava’asu’e Falefatu Sapolu has ordered Prosecution to serve the substitute charges to defense lawyer of suspended newspaper editor Tupuola Terry Tavita no later than today.

The order came after Prosecution asked for another adjournment of the matter so they could finalise their case.

However, Patu, who had the case adjourned twice last year, today issued the order.

“The reason why we have this extra Monday for criminal matters is because of the high number of criminal cases before the Court. But if you keep on asking for adjournments, it will defeat the purpose of the Court,” said His Honour.

Last week, he voiced his disappointment against Prosecution for presenting “un-finalised” matters before the Court.

The defendant is yet to enter a plea to the charge of attempted rape because Prosecution has not finalised the charges.

Defense lawyer Diana Roma confirmed that she has not been served with any substitute charges mentioned by Prosecution in Court today.

Tupuola is facing an alleged attempted rape charge filed by a journalism student late last year who was serving work experience with the Savali newspaper Tupuola was editor.
